1 The plaintiff in error, hereinafter referred to as defendant, was tried in the court of common pleas of Tulsa County on information charging him with having sold a one-half pint of whiskey to Fred Stapp, deputy sheriff. A jury was waived. Defendant was found guilty and sentenced to thirty days in jail, and to pay a fine of $50. Appeal has been perfected to this court.
